We will setup your account after we have received your initial payment. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times.
All services provided by OlneyWeb may only be used for lawful purposes. The laws of the State of Maryland and the United States of America apply.
The customer agrees to indemnify and hold harmless OlneyWeb from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Examples of unacceptable content include:
IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, image, filedump, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, commercial audio streaming (more than one or two streams), locally hosted chat scripts, Escrow, High-Yield Interest Programs(HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg’s, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, Pornography / Nudity / Adult Content, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services.
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. Any user who sends out spam will have their account terminated without notice and without refund. Sending spam using our servers causes all our customers on that server to be at risk of having their email blacklisted, so we take it very seriously. POP3 mail is limited to 200 messages per hour, per account.
OlneyWeb reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
OlneyWeb reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of OlneyWeb.
You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. At your option, your account may be set up for recurring payment, in which case you agree that until and unless you notify us of your desire to cancel any or all services received, those services will be billed on a recurring basis.
As a client of OlneyWeb, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. OlneyWeb provides a 10 day grace period from the time the invoice is due and when it must be paid. Any invoice that is overdue for 10 days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full.
We reserve the right to change our hosting rates and/or the resources provided for any plan at our discretion, with 30 days notice to you, the customer.
Your use of the service is at your sole risk. Files and data are automatically backed up on the server nightly and maintained for two weeks; however, the ability to restore these files is not guaranteed. If you require additional backup services, please contact us for details.
We reserve the right to cancel the account at any time.
Customers may cancel at any time in the first 30 days. We give you an unconditional 30 day money back guarantee for webhosting services, provided your account is not cancelled for cause. Refund requests after 30 days will NOT be honored.

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused bandwidth in one month cannot be carried over to the next month.
We reserve the right to change prices listed on our site, and the right to increase/decrease the amount of resources given to plans at any time. Customers will be subject to the new prices level at the time of their next payment or 30 days after the price change is posted, whichever comes later.
Customer agrees that it shall defend, indemnify, save and hold OlneyWeb harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against OlneyWeb, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless OlneyWeb against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with OlneyWeb; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from OlneyWeb’s server.
By using any OlneyWeb services, you agree to binding arbitration. If any disputes or claims arise against OlneyWeb or its subsidiaries, such disputes will be handled by an arbitrator of OlneyWeb’s choice. All decisions rendered by that arbitrator will be binding and final. You are also responsible for any and all costs related to such arbitration.
OlneyWeb shall not be responsible for any damages your business may suffer. OlneyWeb makes no warranties of any kind, expressed or implied for services we provide. OlneyWeb disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by OlneyWeb and its employees.
OlneyWeb may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies.
We will cooperate fully with law enforcement agencies.
OlneyWeb reserves the right to revise its policies at any time without notice.
Accounts are limited to sending 200 email messages per hour. A message sent to multiple recipients counts as multiple messages. This limit is also applied towards mailing lists. If you send over this amount in any hour the emails may bounce back with a undeliverable error.
We request that you limit checking your email to 60 POP checks per hour per domain. If you go over this amount you are likely to get a wrong password error message saying “login incorrect.” Just wait an hour and it will automatically unlock you. To prevent this from happening again make sure to disable auto checking or at least set it to a value such as 10 minutes or higher.
Any mailing list larger than 5,000 will require a semi dedicated or dedicated hosting solution from us. Note: dividing one large list into smaller lists to get below this limit is not allowed.
Any mailing list over 200 emails requires special handling that must be approved by OlneyWeb in advance.
You are not allowed to mail to a mailing list you were given or purchased. This is spamming because they never agreed to you personally sending them mail. We do not care how you justify it. This is spam and will result in termination of the offending account.
Any unsolicited e-mail being sent will result in termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail.
Any mailing list MUST comply with all guidelines set forth by the United States. These can be found at: http://www.ftc.gov/bcp/conline/pubs/buspubs/canspam.htm.
No Direct SMTP mailers are allowed. An example of this is DarkMailer. Any mail should be relayed through the local MTA (localhost:25) for further delivery by the server and not done directly by scripts.

We may from time to time provide information of a general nature to third parties, such as the number of individuals using our services or the amount of traffic the websites on our servers receive, but we will not use any information that could identify you or your account with us without your permission.
OlneyWeb may disclose any client information to law enforcement agencies without further consent or notification to the client upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
